Summary

This bill tried to change state law by adding sections about autism coverage (a similar bill from the same session did add these sections; that bill is summarized above). Here is how this bill is different than what is currently in the law (the current sections of the state insurance law are summarized at the bottom of this page under “West Virginia Parity Law,” “Autism Coverage”):

  • No age limit for coverage
  • Forbids plans from using visit limits for outpatient care
  • Forbids plans from using financial requirements that are different than those used for other medical services
  • Requires a $36,000 annual maximum for applied behavior analysis that can be adjusted for inflation
  • Does not specifically list rett’s disorder or childhood disintegrative disorder
  • Plans can only review a child’s treatment plan once a year and there are no specific requirements for what a provider must show a plan during this review
  • Treatment for autism is listed as Habilitative or rehabilitative care, Pharmacy care, Psychiatric care, Psychological care, Therapeutic care (all of these terms are defined as well)
